NOTICE OF RIGHT TO REQUEST EDUCATIONAL BEST INTEREST HEARING
When a child becomes habitually truant (has six or more unexcused absences), the child may not transfer during the school year to a cyber charter school unless a judge determines the transfer to be in the educational best interest of the child. A person in parental relation to a child (a biological or adoptive parent, guardian, or person with whom the child lives and who is acting in a parental role of a child) who resides in the same household as the child, or a child who is 15 years or older, may file a request for an educational best interest hearing.
To make this Request, you must file the form found at PaCourts.us/forms/for-the-public. This Request must be filed at the Magisterial District Court or Municipal Court based upon the location of the school where the child is currently enrolled or where the child resides if they attend a cyber charter school.
For Keystone Charter School students, requests for such a hearing would be filed with Judge Brian Arthur at 14 North Race Street, Greenville, PA, 16125. His office can be reached at (724) 588-3210. You will also need to provide a copy of the request to Cindy Nehlen at 425 South Good Hope Road, Greenville, PA, 16125. You can reach her at (724) 588-2511, ext. 103.
By filing a request for a hearing, you are asking the court to determine whether it is in the child’s educational best interest to transfer to a cyber charter school during the school year.
For additional information regarding this Request, you may wish to review 24 P.S. 13-1333.
